1. Agreement to Terms

By accessing and using Wermom (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years of age or the age of majority in your jurisdiction to use this Service. By using Wermom, you represent and warrant that you meet these age requirements.

2. Description of Service

Wermom is a subscription-based baby health tracking application designed for parents and caregivers of infants and children from pregnancy through the first 6 years of life. The Service includes the following features:

3. Account Registration

To use Wermom, you must create an account. When registering, you agree to:

You are solely responsible for the security of your account. Wermom reserves the right to suspend or terminate any account that violates these Terms or for any reason at our discretion, including suspicious activity or breach of these Terms.

4. Subscription & Billing

Free Trial

Wermom offers a free trial period to new users. The duration of the free trial will be communicated to you during registration. At the end of the free trial, your account will automatically convert to a paid subscription unless you cancel before the trial period ends.

Auto-Renewal

By subscribing to Wermom after the free trial ends, you authorize us to automatically charge your payment method at the beginning of each billing cycle. Subscriptions automatically renew unless you cancel.

Pricing & Price Changes

Wermom pricing is displayed at the time of purchase. We reserve the right to change subscription pricing at any time. If we increase prices, we will provide you with at least 30 days' written notice. Your continued use of the Service after a price increase constitutes acceptance of the new pricing.

Cancellation Policy

You may cancel your subscription at any time. For complete cancellation instructions and terms, please refer to our Cancellation Policy.

Refunds

Refunds are handled according to our Cancellation Policy. Please review that policy for specific details regarding refund eligibility.

5. Acceptable Use

You agree not to use Wermom for any unlawful or harmful purposes. Specifically, you agree not to:

Not Medical Advice

The AI Health Chat feature in Wermom is powered by Claude AI (Anthropic) and is provided for informational and educational purposes only. The AI-generated responses are NOT medical advice, are NOT a diagnosis, and are NOT a substitute for professional medical care.

Not a Healthcare Provider

Wermom is not a healthcare provider, and no doctor-patient relationship is created by using the Service. The information provided by the AI chat feature is general in nature and should not be relied upon as a substitute for professional medical diagnosis, treatment, or advice from a qualified healthcare provider.

Always Consult a Healthcare Provider

You must always consult with a qualified healthcare provider (such as your pediatrician, family doctor, or medical specialist) before making any medical decisions regarding your child's health, including treatment decisions, medication changes, or responses to symptoms. In case of medical emergency, call emergency services or go to the nearest emergency room immediately.

Limitations of AI

The AI Health Chat may not have access to your complete medical history or context, and AI systems can make mistakes or provide inaccurate information. You should never rely solely on AI responses for health decisions. The accuracy, completeness, and relevance of AI-generated content cannot be guaranteed.

Health Reports

Health reports generated by Wermom are compilations of the data you have logged and standard developmental references. These reports are for your informational use only and should not be interpreted as medical assessments or diagnoses. Share reports with your healthcare provider for context, but understand that healthcare providers make medical determinations based on clinical evaluation, not app-generated data.

Responsibility

You assume all responsibility for decisions made based on information from Wermom. Wermom, its developers, and Anthropic shall not be held liable for any consequences arising from your use of the AI chat feature or any medical decisions you make based on its responses.

7. Intellectual Property

Wermom and all of its content, features, functionality, and design are owned by Wermom, its licensors, or other providers of such material. This includes but is not limited to:

User Data Ownership

You retain ownership of all data you input into Wermom (such as health logs, daily observations, and child information). However, you grant Wermom a limited, non-exclusive license to process, store, and use your data for the purposes of providing the Service, including generating reports, tracking metrics, and improving our algorithms.

Restrictions

You may not reproduce, distribute, transmit, publicly display, or make derivative works of any portion of the Service without our prior written consent. All rights not expressly granted are reserved.

8. User-Generated Content

Responsibility

You are responsible for all content you create, post, or transmit through Wermom, including community posts, messages, and any other user-generated material. You represent and warrant that you have the right to post such content and that it does not violate any third-party rights or applicable laws.

License to Wermom

By posting content in community features, you grant Wermom a perpetual, irrevocable, worldwide, non-exclusive license to display, store, and use such content in connection with providing the Service. This allows us to moderate, display, and archive community content.

Moderation

Wermom reserves the right to review, edit, or remove any user-generated content that violates these Terms or is otherwise inappropriate, at our sole discretion. We are not obligated to monitor user content, but we reserve the right to do so.

Privacy in Community

Do not post personal health information, medical records, or other sensitive data in public community features. While Wermom monitors for abuse, we cannot guarantee the privacy of information posted in community spaces. Share responsibly and consider using private messaging or direct healthcare providers for sensitive medical discussions.

9. Privacy

Your privacy is important to us. Your use of Wermom is governed by our Privacy Policy, which details how we collect, use, disclose, and protect your personal information and your child's health data.

By using Wermom, you consent to the collection and processing of your data as described in the Privacy Policy. Please review the Privacy Policy carefully to understand our privacy practices.

10. Third-Party Services

Wermom integrates with third-party services to provide certain features. Your use of these third-party services is subject to their own terms and conditions:

Anthropic (Claude AI)

The AI Health Chat feature is powered by Claude AI, developed by Anthropic. Use of Claude is subject to Anthropic's Terms of Service and Privacy Policy. Your health chat queries will be processed by Anthropic as described in those terms.

Resend (Email Service)

We use Resend to deliver notification emails and communications. Resend's privacy and service terms apply. For details, visit resend.com.

Supabase (Database & Backend)

We use Supabase for backend infrastructure and database services. Your data is stored and processed by Supabase subject to their Terms of Service.

Wermom is not responsible for these third parties' practices. We encourage you to review their terms and privacy policies independently.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WERMOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WERMOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL WERMOM'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO WERMOM IN THE 12 MONTHS PRECEDING THE CLAIM, OR, IF YOU HAVE NOT PAID ANYTHING, ZERO DOLLARS.

Some jurisdictions do not allow the limitation or exclusion of certain types of damages, so the above limitations may not apply to you. In such cases, Wermom's liability will be limited to the maximum extent permitted by law.

This limitation applies to all claims whether based in contract, tort, negligence, strict liability, or any other legal theory.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wermom, its founders, employees, agents, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to:

This indemnification obligation survives termination of your account and these Terms.

14. Termination

Termination by You

You may terminate your account at any time by following the cancellation process outlined in our Cancellation Policy.

Termination by Wermom

Wermom may suspend or terminate your account at any time, with or without cause, at its sole discretion. This includes termination for violation of these Terms, illegal activity, or any reason deemed necessary in our judgment.

Data Upon Termination

Upon termination of your account, your data will be retained for 30 days to allow for account recovery if desired. After this 30-day period, your data will be permanently deleted and cannot be recovered. You are responsible for maintaining your own backups if needed.

Survival

The following sections survive termination: Intellectual Property, Indemnification, Limitation of Liability, Governing Law & Dispute Resolution, and any other provisions that by their nature are meant to survive termination.

15. Governing Law & Dispute Resolution

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

Jurisdiction

You irrevocably agree that any legal action or proceeding arising out of these Terms or your use of the Service shall be brought exclusively in the courts located in Ontario, Canada, and you consent to the jurisdiction and venue of such courts.

Dispute Resolution - Mediation First

Before pursuing any legal action, you agree to attempt to resolve any dispute through good-faith negotiation with Wermom. If negotiation is unsuccessful, you agree to participate in mediation before initiating litigation. Mediation shall be conducted in Ontario, Canada.

Class Action Waiver

To the extent permitted by law, you and Wermom agree that any dispute shall be resolved on an individual basis. You agree not to bring any claim as part of a class action, class arbitration, or any other representative proceeding. Class actions are waived to the fullest extent permitted by applicable law.

16. Severability, Entire Agreement & Assignment

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy and Cancellation Policy, constitute the entire agreement between you and Wermom regarding your use of the Service and supersede all prior negotiations, understandings, and agreements, whether written or oral.

No Waiver

Failure by Wermom to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Wermom.

Assignment

You may not assign or transfer your rights or obligations under these Terms without Wermom's prior written consent. Wermom may assign these Terms to any successor entity without your consent.

17. Changes to Terms

Wermom reserves the right to update or modify these Terms at any time. We will provide you with at least 30 days' written notice of any material changes via email or through the Service. Your continued use of Wermom after the notice period constitutes your acceptance of the updated Terms.

If you do not agree with the changes, you have the right to cancel your account and discontinue use of the Service before the new Terms take effect.
