1. Overview

Wermom is a subscription-based baby health tracking app designed for parents from pregnancy through the first six years of a child's life. We offer flexible subscription plans and provide a free trial period to evaluate the service before committing to a paid plan.

This policy explains how you can cancel your subscription, the refund terms that apply, and your consumer protection rights. We want you to feel confident in your subscription with us.

2. Free Trial Period

Wermom offers all users a free trial period to explore the app's features and evaluate whether it meets your needs.

Key Points About Your Free Trial:

  • No charge during trial: You will not be charged any fees during your free trial period.
  • Cancel anytime: You may cancel your subscription at any time during your trial period.
  • No charges for cancellation: If you cancel during your trial, you will not be charged, and no refund is necessary.
  • Automatic conversion: If you do not cancel before your trial period ends, your subscription will automatically convert to a paid plan at the end of the trial.
  • Pre-conversion notification: You will receive a notification before your trial period ends and before any charges are applied to inform you of the upcoming conversion and give you the opportunity to cancel if you wish.

Important: Please check your email for trial expiration notices. If you do not wish to be charged, ensure you cancel before your trial period ends.

3. Cancellation

You may cancel your Wermom subscription at any time. Here's what you need to know:

How to Cancel:

  • Cancel through your account settings in the Wermom app or website
  • Contact us at hello@wermom.com and request cancellation

When Cancellation Takes Effect:

  • End of billing period: Your cancellation becomes effective at the end of your current billing cycle. You will retain full access to all features until that date.
  • No mid-cycle refunds: We do not provide refunds or credits for unused portions of your current billing period.

Data After Cancellation:

After you cancel your subscription, your health data and reports will be retained for 30 days. After this 30-day period, your data will be permanently deleted from our servers. This grace period allows you time to download or back up your data if needed. Data may be retained longer if required by law.

4. Refund Policy

Understanding our refund policy will help you know what to expect when you cancel your subscription.

During Free Trial

If you cancel during your free trial period, there is no charge and no refund is required. Your access will simply end at the conclusion of your trial period.

After Free Trial Ends

Generally, subscriptions are non-refundable. Once your trial period has ended and you transition to a paid subscription, charges for that billing period are considered final.

Critical Limitation: Health Reports & Digital Goods

Once you have accessed or viewed any health report after your trial period, NO refund will be issued.

Health reports provided through Wermom are digital goods that are consumed upon viewing. By viewing or accessing a health report, you have substantially benefited from the service, and therefore the service has been substantially performed. Refunds cannot be issued in these circumstances.

This applies regardless of the amount of time that has passed since the charge or the reason for your cancellation request.

Exceptions Where Refund May Be Considered

Wermom may, at its sole discretion, consider issuing a refund in the following circumstances:

  • Technical issues: If a technical problem prevented you from accessing the service for an extended period, and the issue was not caused by factors outside our control or by misuse of the app on your end
  • Unauthorized charges: If you believe a charge was made to your account without authorization (must be reported within 30 days of the charge)
  • Billing errors: If we made a clear error in billing or charging you incorrectly

Important: Any potential refund is entirely at Wermom's discretion. Even if one of these exceptions applies, we may choose to offer a partial refund, service credit, or other remedy rather than a full cash refund. There is no guarantee that a refund will be approved.

How to Request a Refund

If you believe you qualify for a refund under one of the exceptions listed above, follow the process in Section 5 below.

5. How to Request a Refund

To request a refund, please follow these steps:

Submission Process

  1. Email us: Send your request to hello@wermom.com
  2. Subject line: Use "Refund Request" as your email subject
  3. Include the following information:
    • Your account email address
    • The date of the charge in question
    • The amount of the charge
    • A clear explanation of why you are requesting a refund
    • Any relevant details (e.g., screenshots of errors, dates of technical issues, etc.)

Response Timeline

  • Initial response: We will respond to your refund request within 5 business days
  • Refund processing: If your refund is approved, you will receive the funds within 10 business days, returned to your original payment method
  • Communication: We will notify you of the refund status via email

Please note: Refund requests submitted more than 14 days after the charge date may not be considered. For unauthorized charges, please report within 30 days.

6. Price Changes

Wermom reserves the right to change subscription pricing. Here's how we handle price adjustments:

Notice & Existing Subscribers

  • 30-day advance notice: We will provide at least 30 days' notice before any price increase takes effect
  • Grandfathering: Existing subscribers will continue to pay the old price until their next renewal date after the 30-day notice period ends
  • Right to cancel: You have the right to cancel your subscription before the new price takes effect

If a price increase is announced, you will receive an email notification with details about the new price and the effective date. You can cancel at any time before the new price applies without penalty.

7. Jurisdiction-Specific Consumer Rights

Depending on where you live, you may have additional consumer protection rights that apply to your subscription with Wermom. This section outlines key protections by jurisdiction:

Canada

Wermom is incorporated in Ontario, Canada. Consumer protection laws in Canada, including provincial consumer protection legislation, may provide you with additional rights beyond those stated in this policy. Nothing in this cancellation and refund policy limits or excludes the rights you have under applicable Canadian consumer protection laws. If you have questions about your rights under Canadian law, please contact us at hello@wermom.com.

European Union & United Kingdom

Under the EU Consumer Rights Directive and UK consumer protection law, consumers have a 14-day right of withdrawal for digital services. However, this right is lost if you have expressly consented to the commencement of performance of the service and acknowledged that you lose the right to withdraw.

For Wermom users: Once you access or view any health report or utilize core features of the app, you are indicating your consent for performance to begin and your acknowledgment of the loss of withdrawal rights. If you wish to exercise your withdrawal right, you must do so before accessing health reports or other key features.

If you are located in the EU or UK and have questions about your withdrawal rights, please contact us at hello@wermom.com.

United States - California

California's Automatic Renewal Law (ARL) requires clear disclosure before charging for automatic renewals and provides an easy cancellation mechanism. Wermom complies with these requirements by:

  • Clearly disclosing subscription terms and pricing before trial conversion
  • Sending reminder notifications before trial expiration
  • Providing multiple, easy methods to cancel (app settings or email)
  • Honoring cancellation requests promptly

Australia

Wermom respects the Australian Consumer Law, which provides statutory guarantees regarding services. This policy does not exclude, restrict, or modify any statutory guarantees or consumer rights you have under the Australian Consumer Law. If you believe you have a claim under the Australian Consumer Law, please contact us at hello@wermom.com.

General Principle

Where the consumer protection laws of your jurisdiction provide you with greater protection or rights than those stated in this policy, those local laws will prevail.
